Terms and Conditions

By creating an account, accessing, or using RateMySupplements (the "App," "Platform," "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, do not use the App. We may update these Terms at any time; continued use after changes constitutes acceptance of the revised Terms.

You must be at least 18 years old to create an account. By registering, you represent that you meet this age requirement and have the legal capacity to enter into this agreement. We reserve the right to request age verification and to terminate accounts of users found to be underage.

3.1 The App is a platform for users to share personal experiences regarding supplement use. Nothing on the App constitutes medical advice, diagnosis, or treatment.

3.2 The App, its owners, and operators are not licensed medical professionals, pharmacists, dietitians, or healthcare providers, and no content on the App should be interpreted as such.

3.3 Content shared by users reflects individual, subjective experience only. It has not been evaluated or approved by Health Canada, the FDA, or any regulatory body, and is not a substitute for professional medical consultation.

3.4 You should consult a qualified healthcare provider before starting, stopping, or changing any supplement regimen, especially if you are pregnant, nursing, have a medical condition, or are taking prescription medication.

3.5 We do not verify, endorse, or guarantee the accuracy, safety, or efficacy of any supplement, dosage, or practice described by users on the App.

3.6 No Reliance. You acknowledge that any reliance you place on information found on the App is at your own risk.

Users may not post content that:

• 4.1 Makes therapeutic claims that a supplement can cure, treat, prevent, or mitigate any disease or medical condition (e.g., "this cures anxiety," "this treats insomnia") — such claims are regulated under the Food and Drugs Act and Natural Health Products Regulations (Canada) and equivalent laws elsewhere, and are not permitted regardless of the poster's belief in their accuracy.
• 4.2 Recommends specific dosages, especially of a nature that could encourage unsafe use, overdose, or interaction risk.
• 4.3 Promotes the use of unregulated, banned, or prescription-only substances without appropriate context or disclosure.
• 4.4 Constitutes medical advice directed at another specific user (e.g., "you should take X for your condition").
• 4.5 Is false, misleading, defamatory, or deceptive.
• 4.6 Promotes eating disorders, self-harm, or substance abuse.
• 4.7 Infringes on any third party's intellectual property, privacy, or other rights.
• 4.8 Constitutes spam, unauthorized advertising, or affiliate marketing without disclosure.
• 4.9 Violates any applicable law, including advertising standards set by the Competition Bureau of Canada or equivalent bodies.

We reserve the right, but not the obligation, to remove any content and suspend or terminate any account that violates these Terms, at our sole discretion and without prior notice.

5.1 You retain ownership of content you post ("User Content"). By posting, you grant RateMySupplements a non-exclusive, worldwide, royalty-free, transferable license to use, display, reproduce, and distribute your User Content in connection with operating and promoting the App.

5.2 You are solely responsible for your User Content and represent that you have the right to post it and that it does not violate these Terms or any law.

5.3 We do not pre-screen User Content but reserve the right to review, moderate, and remove content at our discretion.

5.4 You acknowledge that other users' content reflects their own views and experiences, not those of RateMySupplements.

6.1 RateMySupplements is a neutral hosting platform for user-generated content. We do not create, verify, or endorse the health claims, product recommendations, or personal experiences shared by users.

6.2 Disclaimer of Warranties. THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

6.3 Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, RATEMYSUPPLEMENTS, ITS OWNERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, HEALTH COMPLICATIONS, OR DAMAGES ARISING FROM RELIANCE ON USER-GENERATED CONTENT, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

6.4 Our total liability for any claim arising from your use of the App shall not exceed CAD $100 or the amount you paid us in the past 12 months (which may be $0 given no purchases occur on the platform), whichever is greater.

6.5 Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

You agree to indemnify, defend, and hold harmless RateMySupplements, its owners, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: (a) your use of the App; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any law or third-party right.

8.1 Our collection and use of personal information is governed by our Privacy Policy, which forms part of these Terms.

8.2 Supplement and health-related information you choose to share is done voluntarily. You understand this information may be visible to other users depending on your privacy settings.

8.3 We comply with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation.

8.4 You may request access to, correction of, or deletion of your personal information by contacting ratemysupplements@gmail.com.

8.5 We do not sell your personal information to third parties.

9.1 You may delete your account at any time by contacting us.

9.2 We reserve the right to suspend or terminate your account, without notice, if we believe you have violated these Terms, posted prohibited content, or engaged in conduct harmful to other users or the platform.

9.3 Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination (including Sections 6, 7, 10, and 11) will survive.

10.1 These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

10.2 Any dispute arising from these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of Ontario.

11.1 Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and RateMySupplements.

11.2 Severability. If any provision is found unenforceable, the remaining provisions remain in full effect.

11.3 No Waiver. Our failure to enforce any right or provision does not constitute a waiver of that right.

11.4 Assignment. We may assign these Terms in connection with a merger, acquisition, or sale of assets. You may not assign your rights under these Terms without our consent.
